We strive to protect your data in accordance with applicable data protection laws and technical possibilities. Personal data is generally transmitted in encrypted form. This privacy policy is regularly updated and adapted to the applicable laws and our offered services (see Section 13). The current privacy policy always applies. Special, supplementary, or additional privacy policies or other legal documents such as General Terms and Conditions (GTC), Terms of Use, or Participation Conditions may apply to specific offers and services.

3. Processing of Personal Data

By using this website, you consent to the collection, processing, and use of data as described below.

3.1 Definitions

Personal data refers to all information related to an identified or identifiable individual. This can include, for example, a person’s name, address, email address, or phone number. An affected person is an individual about whom personal data is processed. Processing includes any handling of personal data, regardless of the means and methods used, especially storage, transmission, acquisition, deletion, retention, alteration, destruction, and use of personal data.

3.2 Legal Bases

We process personal data in accordance with the applicable data protection law on the following legal bases:

  • Processing of personal data with the consent of the affected person.
  • Processing of personal data to fulfill a contract with the affected person and to carry out corresponding pre-contractual measures.
  • Processing of personal data to fulfill a legal obligation.
  • Processing of personal data to protect the vital interests of the affected person or another natural person.
  • Processing of personal data to protect our legitimate interests or those of third parties, provided that the fundamental freedoms and rights and interests of the affected person do not outweigh. Legitimate interests include, in particular, our business interest in being able to provide our website, information security, enforcement of our own legal claims, and compliance with applicable law.

3.3 Nature and Scope

We only process the personal data that is necessary to provide our services securely, reliably, and in a user-friendly manner. This includes, among other things, the following data categories:

  • Identity data (e.g. title, first name, last name, date of birth and gender, employer);
  • contact data (e.g. billing address, delivery address, email address and telephone numbers);
  • technical data (e.g. internet protocol address («IP«), browser type and version, time zone setting and location, browser plug-in types and versions, operating system and other technology on the devices you use to access this website;
  • profile data (e.g. username and password, preferences, feedback and survey responses);
  • usage data (e.g. information about how you use our website, products and services, including sales, contracts;
  • payment data.

We do not collect any sensitive data about you, such as data about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, information about your health, and genetic and biometric data, or any information about criminal convictions and offences.

We generally only process personal data with the consent of the affected person, unless processing is allowed for other legal reasons, such as fulfilling a contract or protecting our legitimate interests. We also process data that we receive from third parties, from publicly accessible sources, or in the provision of our services, provided that this is legally permissible.

3.4 Duration

We process personal data for the duration necessary for the respective purpose. In the case of longer retention obligations due to legal and other obligations that we have, we limit the processing accordingly.

The criterion for the duration of personal data storage is the respective statutory retention period. Once the deadline has expired, we routinely delete the data, unless they are still required for the fulfillment or initiation of contracts.

3.5 Data Collection

We collect personal data mainly through you (see Section 7, 8, and 9).

3.6 Purposes

We process personal data in particular for the following purposes:

  • To enter into and maintain contractual relationships in particular in connection with the services provided through our website;
  • To comply with our domestic and foreign legal obligations;
  • to communicate with you;
  • for marketing purposes and relationship management (e.g. to send personalized advertising for products and services from us);
  • for market research, to improve our services and operations and for product development;
  • for security and access control purposes;
  • for risk management and as part of our corporate governance, including business organization and development;
  • for further purposes, e.g., for internal processes and administration or for quality assurance.

4. Rights of Affected Individuals

According to applicable laws, you have various rights regarding your personal data. You can assert the following rights with our data protection officer:

  • Information about your stored data and the associated processing;
  • Correction of incorrect personal data;
  • Deletion of your stored data;
  • Restriction of data processing if we are not yet allowed to delete your data due to legal obligations;
  • Objection to the processing of your data;
  • Data portability, i.e., receiving the stored data in a machine-readable format, if you have given your consent to data processing or have entered a contract with us;
  • Revoke consent, where our processing is based on your consent.

If you wish to exercise the above-mentioned rights in relation to us, please contact us in writing, at our premises or, unless otherwise specified or agreed, by e-mail; you will find our contact details in Section 1. In order for us to be able to prevent misuse, we need to identify you (for example by means of a copy of your ID card, unless identification is not possible otherwise).

If you wish to revoke your consent, you may do so at any time by sending us an informal email. The legality of the processing carried out until the revocation is not affected by this.

Please note, however, that we reserve the right to enforce statutory restrictions on our part, for example if we are obliged to retain or process certain data, have an overriding interest (insofar as we may invoke such interests) or need the data for asserting claims. If exercising certain rights will incur costs on you, we will notify you thereof in advance.

The competent data protection authority of Switzerland is the Federal Data Protection and Information Commissioner (www.edoeb.admin.ch).

5. Data Security

While we take reasonable technical and organizational measures to ensure data protection, the processing of personal data on the internet always carries potential security risks. Therefore, we cannot guarantee complete data security.

Access to our online offering is via transport encryption (SSL/TLS, especially with Hypertext Transfer Protocol Secure, abbreviated HTTPS). Most browsers indicate transport encryption with a padlock in the address bar.

Access to our online offering is subject, like any other use of the internet, to monitoring by security authorities in Switzerland, the EU, the USA, and other countries, without specific suspicion. We have no direct influence on the processing of personal data by intelligence agencies, police, and other security authorities.

6. Use of Technologies

To continuously improve the quality of our services, the following technologies are integrated into our website:

6.1 Cookies

In certain cases, we may use cookies. Cookies optimize the information and offerings on our website for the benefit of users. Cookies allow us to recognize users of our website. The purpose of this recognition is to facilitate the use of our website for users. You can prevent cookies from being set by our website at any time by adjusting the appropriate settings in your internet browser and thus permanently object to the setting of cookies.

6.2 Use of Google Analytics

Google Analytics is a web analysis service. Our web analysis involves the anonymous collection, collection, and evaluation of data regarding the behavior of visitors to websites. A web analysis service records data about which third-party website a user came to our website from, which subpages of the website were accessed, or how often and for what duration a subpage was viewed. Google Analytics uses a cookie to record this information. As mentioned above, you can prevent cookies from being set by our website at any time by adjusting the appropriate settings in your internet browser.

6.3 Use of Script Libraries

To display content correctly, we use script and font libraries on our website (e.g. Google Webfonts). Calling up a script or font library results in a connection being established to the provider of the library. It is possible that the operator of the library collects data from this connection.

6.4 Use of Google Maps

We use an interface to geospatial data from Google to visualize location-based information. Google records and uses data about the use of the map function. Information about data usage by Google can be found in Google’s privacy policy.

6.5 Use of Social Plugins

Our website may use social plugins from various providers of social networks. Through these plugins, the corresponding social networks may use certain information, including personal data. If the individual concerned is logged into a social network during the visit to our website, it can be assumed that personal data will be transmitted. We have no control over which data is used. We do not use social plugins to record personal data. The privacy policies of the respective social networks provide information about the collection, processing, and use of personal data.

7. Contact Form

If you send us inquiries via a contact form, we store the information and contact details you provide to process your inquiry and respond to any follow-up questions. We do not pass on this data to third parties without your consent. The processing of the data entered in the contact form is based exclusively on your consent. The data entered by you in the contact form will remain with us until you request us to delete it, revoke your consent to its storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions – in particular retention periods – remain unaffected.

8. Data Collection in Job Applications

As part of a job application process, we may collect and process personal data provided by applicants. This can also be done electronically, especially if applicants submit their documents by email or via an online form on our website.

9. Newsletter

You can subscribe to our company’s newsletter via a form or email. If possible, a confirmation email will be sent to the registered email address when the newsletter is sent for the first time using the double-opt-in procedure. You have the option to unsubscribe from the newsletter at any time. Each newsletter contains an appropriate unsubscribe link. If this link is missing, we ask you to contact the data protection officer of our website.

9.1 Tracking Pixels

Our newsletter may contain a tracking pixel. A tracking pixel is a miniature graphic embedded in such emails to enable the recording and analysis of log files. These serve to statistically evaluate the success or failure of online marketing campaigns. The analysis can be anonymous or linked to personal data.

9.2 Mailchimp

We use the Mailchimp service to send newsletters. By subscribing to our newsletter, you consent to your email address being transmitted to Mailchimp in order to receive our newsletter. Your data will be processed by Mailchimp in accordance with the company’s provisions and applicable data protection laws. We recommend that you familiarize yourself with Mailchimp’s privacy policy and terms before subscribing to our newsletter. Please note that, as the provider of the website, we have no control over the processing of your data by Mailchimp and are not responsible for it. Further information can be found in Mailchimp’s privacy policy at https://mailchimp.com/legal/privacy/.

10. Services of Third Parties, Including Abroad

We use services from third parties to provide our offering permanently, user-friendly, securely, and reliably. Such services also serve to embed content into our website. Such services – such as hosting and storage services, video services, and payment services – require your Internet Protocol (IP) address, as such services cannot otherwise transmit the corresponding content. Such services may be located outside of Switzerland and the European Economic Area (EEA) if adequate data protection is ensured. For their own security-related, statistical, and technical purposes, third parties whose services we use can also process data related to our offering and from other sources – including cookies, log files, and tracking pixels – aggregated, anonymized, or pseudonymized.

11. Copyrights

The content contained on our website, such as texts, images, graphics, and videos, is protected by copyright. Any use, reproduction, or distribution of this content without express permission from the data protection officer, as the copyright holder, is prohibited. If you wish to use content on our website, please contact the data protection officer so that we can grant you the necessary permission. We do not assume liability for the infringement of copyrights by third parties who use content on our website without our permission.

12. General Disclaimer

The information provided on our website is provided “as is” and without any warranty, neither express nor implied, regarding its accuracy, timeliness, completeness, or quality of the information provided on our website. Claims for liability against us relating to material or immaterial damage caused by the use or non-use of the information provided or by the use of incorrect or incomplete information are excluded unless the provider can be proven to have acted with intent or gross negligence. We reserve the right to change, add to, delete, or temporarily or permanently discontinue parts of the pages or the entire offering without separate notice.

We do not provide any warranty, neither express nor implied, regarding the availability or operation of our website and are not liable, in particular, for damage resulting from the inability to use or technical malfunctions, unless they are due to our intentional or grossly negligent fault.

We do not provide any warranty, neither express nor implied, regarding the content of external links to which we only refer. The operators of the linked pages are solely responsible for their content.

By accessing our website, you expressly agree that we shall not liable for any damages that may arise from the use of our website or from access to external links. This disclaimer applies to all damages and claims, regardless of whether they are based on direct or indirect damages, consequential damages, or damages resulting from lost profits or other financial damages.

13. Changes

We reserve the right to change our privacy policy at any time to adapt it to current legislation, technological developments, or changes in our services. The current version of the privacy policy can always be found on our website. If important changes are made, we will inform you about these changes in an appropriate form.

14. Responsibility and Questions

If you wish to object to the collection, processing, or use of your data by us in accordance with these data protection provisions as a whole or for individual measures, you can address your objection to the data protection officer listed at the beginning of the privacy policy. If you have questions about data protection, please write an email or direct your questions to the data protection officer listed at the beginning of the privacy policy.
